Terms of Service

This page is a working draft. Every item in square brackets needs your business details, and the whole document needs review by a legal advisor before the store opens. It is a starting structure, not legal advice.

1. Who we are

This store is operated by [LEGAL ENTITY NAME], registration number [COMPANY REGISTRATION NUMBER], trading as HeyBro, of [REGISTERED ADDRESS]. You can reach us at [CONTACT EMAIL] or [CONTACT NUMBER]. References to “we”, “us” and “our” mean [LEGAL ENTITY NAME].

2. About these terms

These terms apply to every order placed through heybro.co.za. By placing an order you confirm that you accept them. We may update these terms from time to time, and the version published when you order is the version that applies to that order.

3. Personalised products

Almost everything we sell is personalised to your instructions, which changes how orders work. Please read this section carefully.

  • You are responsible for the accuracy of the names, numbers, spelling and punctuation you supply. We reproduce exactly what you submit and approve.
  • Character limits differ by product and are shown on each product page.
  • We email a proof before anything goes into production. Nothing is made until you approve that proof.
  • Once you approve a proof, the order moves into production and cannot be changed or cancelled.
  • Natural materials such as timber vary in grain and colour, and screen colours differ from finished products. Minor variation is not a defect.

4. Orders

An order is an offer to buy. A contract is formed when we confirm the order and, where personalisation applies, when you approve the proof. We may decline an order — including where a product is unavailable, where the personalisation requested is unlawful or offensive, or where we cannot verify payment.

5. Prices and payment

Prices are shown in South African Rand and [include / exclude] VAT. [State your VAT registration position and number, or remove this sentence if not VAT registered.] Payment is taken at checkout through [PAYMENT PROVIDERS]. If a product is listed at an incorrect price we will contact you before proceeding and you may cancel that order.

6. Delivery

Personalised orders are produced and dispatched within five to seven working days of proof approval. Delivery timeframes after dispatch depend on [COURIER] and your address. We deliver to [DELIVERY AREAS]. Delivery is charged at checkout.

Risk in the goods passes to you on delivery. If an order has not arrived within [NUMBER] working days of dispatch, contact us at [CONTACT EMAIL] so we can trace it.

7. Returns and cancellations

[This section needs legal review. Confirm with your advisor how the Consumer Protection Act and the Electronic Communications and Transactions Act cooling-off provisions apply to goods made to a customer’s specification, and set out your position here.]

Our intended position, to be confirmed:

  • Personalised items cannot be returned or exchanged once a proof has been approved, because they cannot be resold.
  • Unpersonalised items may be returned within [NUMBER] days in unused condition and original packaging.
  • Nothing here limits your rights in respect of faulty, damaged or incorrectly supplied goods.

8. Faulty or incorrect items

If a piece arrives faulty, damaged, or personalised differently from the proof you approved, tell us within [NUMBER] days at [CONTACT EMAIL] with a photograph. We will remake or refund it at our cost. If the error is in the proof you approved, we will quote for a remake.

9. What you supply to us

By submitting a name, number, logo, image or other content for personalisation, you confirm that you are entitled to use it and that it does not infringe anyone else’s rights. We may decline content that is unlawful, offensive, or that appears to infringe a trade mark or copyright.

10. Bulk and team orders

Orders placed through our bulk and team service may be subject to separate lead times, minimum quantities and payment terms, which we will confirm in writing before production begins. Where those terms conflict with this page, the written quotation applies.

11. Liability

[This section must be drafted or approved by a legal advisor. Limitation-of-liability wording that is unfair or non-compliant may be unenforceable and can create risk rather than reduce it.]

12. Privacy

How we handle personal information, including the names and numbers you supply for personalisation, is set out in our Privacy Policy.

13. Governing law

These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction over any dispute. [Confirm the specific court and any dispute-resolution steps you want to require first.]
